工商总局拟要求网购7天无理由退货 4类商品不退-搜狐科技  昨日,国家工商行政管理总局制定的《网络购买商品七日无理由退货指引》开始公开征求意见。该指引拟规定,手机、电脑、数码产品等一经激活或试用后价值贬损较大的商品,可以不适用七日无理由退货规定。但前提条件是要求商家必须在消费者购买时进行“一对一”的告知确认,否则电子商务经营者不得拒绝七日无理由退货。   争议:“其他”可退货的范围不明确   2014年开始实施的新《消法》针对网络购物等新型消费方式,设立了“七日内无理由退货”制度。鉴于“七日内无理由退货”制度规定得较为“原则”,新《消法》在实施过程中,出现了一些新情况和新问题。   国家工商总局相关负责人表示,从实践来看,网络销售的商品种类繁多,商品性质千差万别,商品的包装也差异极大,政府部门很难通过列举具体商品名录的方式规定七日无理由退货制度的适用范围。   截至目前,最大的争议是对商品性质不宜退货的适用范围存在不同理解。《消法》明确规定了消费者定作的商品、鲜活易腐的商品、在线下载或者消费者拆封的音像制品以及计算机软件等数字化商品、交付的报纸或者期刊等四类商品不适用无理由退货。同时规定其他根据商品性质并经消费者在购买时确认不宜退货的商品,不适用无理由退货。   经营者和消费者关于哪些“其他”商品能够适用无理由退货存在不同理解,一些经营者甚至对不适用无理由退货的商品类型进行扩大解释,事实上一定程度上架空了《消法》无理由退货制度,往往导致消费争议发生。   明确:“网购手机”不适用七日无理由退货   为此,工商总局制定的《指引》明确规定,根据商品的性质,增设了四类经消费者在购买时确认可以不适用七日无理由退货规定的商品。即拆封后因人身安全或者生命健康原因不宜退货的商品:包括食品、药品、保健品、化妆品、贴身用品等;一经激活或试用后价值贬损较大的商品:包括产生授权或者激活信息的手机、电脑、数码产品等;已经在线交付的充值类商品:包括手机充值卡、游戏点卡等;特价清仓商品:包括即将到保质期的商品、包装破损或者有瑕疵的商品等。   电子商务经营者应采取技术手段或者其他措施,对于不适用无理由退货的商品进行明确标注,并在商品销售必经流程中设置显著的提示程序,供消费者对单次购买行为进行“一对一”确认。同时,如不按照规定进行“一对一”的确认程序,电子商务经营者不得拒绝七日无理由退货。   界定:打开包装不影响“商品完好”   争议较大的还有对“商品完好”的定义。《消法》第二十五条第三款规定,消费者退货的商品应当完好。但对商品完好的内涵和标准未加以明确。   实践中,有的经营者不仅要求商品本身完好,而且商品包装必须完整,甚至要求商品不得拆封、试用,一定程度上加大了消费者的维权成本。   对此,该《指引》将“商品完好”界定为商品本身、配件及附带的防伪标识、商标吊牌、商品合格证、使用说明书等齐全。储值卡(券)类商品完好是指卡(券)内金额未减少。并进一步明确,消费者基于查验需要而打开商品包装,或者为确认商品的品质、功能而进行合理、适当的试用不影响商品完好。   细化:“七日”起点为签收商品次日   《指引》细化了七日期间的计算方式,七日期间自消费者签收商品的次日开始起算。   期间最后一天是法定节假日的,以节假日结束的次日为最后一天,消费者应在以上期间内发出退货商品。明确要求电子商务经营者应在销售过程中向消费者明确告知其购买商品所需支付运费或者被免除运费的金额,以及真实、准确的退货地址、退货联系人及有效的联系方式。未告知的,七日期间自电子商务经营者正式告知消费者的次日起计算。   据悉,该征求意见反馈截止时间为2016年3月5日。公众可登录国家工商总局网站,通过首页右侧“规章草案意见征集”栏提出意见。   (文 记者 蔺丽爽)相关的主题文章:
