科长以低价购房未被认定受贿 法院称非最低折扣 图与本文无关   深圳市消防监管局建审处工程验收科原科长余×然被检方指控以7 。5折低价从开发商处购房,受贿88万多元。深圳盐田区法院去年12月23日作出一审判决,被告人余×然一审获刑一年十个月。余×然低价买房未被认定受贿,法院的判处理由是,还有其他人享受更低折扣,无法证实开发商设定的最低优惠限额,不能认定被告人是以明显低于市价购房。不过,余×然被认定收受另一笔5万元受贿。余×然系2014年2月被查,正值深圳消防监管局腐败窝案爆发,其所在掌控消防验收的建审处成为重灾区。   验收科科长7 。5折购置房产   余×然2007年开始担任深圳市消防监管局建审处工程验收科副科长,2012年提拔为科长。该科科长的岗位责任为参加建设工程竣工消防验收工作,对验收中发现的违法问题及时组织予以查处。   2014年2月27日,余×然因涉嫌受贿罪被刑事拘留。当时,该局爆发腐败窝案,掌握大权的建审处成了重灾区,从分管的副局长、处长以及副处长等多人被查,已调任他局的该局原局长也卷入其中,案件波及甚广。余×然是被福田区人民检察院办案人员带走调查,侦查人员当时已经掌握其存在利用职务便利低于市场价格购房的犯罪线索。   在讯问阶段,余×然承认以明显低价购买该处房产,并认为与其职务存在关联。他在2011年10月11日签订购房合同,以301万元一次性付款购买南山的田厦翡翠明珠花园1栋B座9楼某房。检方指控显示,该房产建筑面积150平方米左右,折算下来每平方米2万元。而该楼盘销售价目表显示,2010年9月该房对外销售价格单价为2 。6万多元。以此计算,余×然以低至7.5折的价格购买该房,总额将近少了百万元。检方最初按照该楼盘正常优惠不低于9.8折来计算,认定其该笔受贿额度在88万元,此后又按照该楼盘最低优惠不低于9折计算,认定其这笔受贿额度在60多万元。   低折扣买房是如何获得的?   那么,余×然为什么能拿到如此低的折扣呢?田厦公司原董事长郑稳棠2013年5月因为他案获刑8年。他在狱中的证言显示,2010年年底,公司下属的田厦房地产公司总经理陈京说有负责消防验收的人要买房,之前获得该负责人关照,她也答应要给予优惠。于是,郑稳棠签字同意了。   该楼盘销售总监郑某松证实,经由陈京之手收到郑稳棠签字的纸条,标注购房人、房号以及2万 平方米的价格。公司对外销售的房子一般是9.8折、9.9折,7.5折是不可能的,因此需要董事长签字。   田厦公司还提交一份销售表显示,2011年10月,除余×然购买该房产外,该楼盘还售出其他六套房产,享受的折扣均在9折及以上。另一关键证人田厦房地产公司总经理陈京并未被侦查机关找到。郑某松的证言说,2012年公司原董事长郑稳棠被查之后,陈京离职不知去向。   检方认定低价购房收好处费   以深华消防设备工程股份有限公司名义承揽该楼盘消防工程的朱洪升的证言,对余×然以职务之便低价购房也予以佐证。朱洪升在证言中说,他曾经陪着陈京一起去找过余×然了解消防验收情况,并当着陈京的面表示,余×然以后买房有折扣,陈京允诺优惠没问题。   余×然在侦查阶段供述,2009年下半年他尚为副科长,带同事到该楼盘对消防工程进行预验收,发现地下室车库喷淋方式不符合安全规范要求,需要整改。   如果不能通过消防验收,楼盘销售将受影响,这令陈京以及消防工程负责人朱洪升非常紧张。余×然称,朱洪升在南山检察院对面的小村子安排饭局,与陈京、郑稳棠见了面。此后,陈京不放心,与朱洪升到办公室找过他,承诺优惠购房事宜。而该楼盘的消防工程经过整改后,最终通过消防验收。综合前述证人证言及被告人供述,检方认定田厦公司在余×然对田厦翡翠明珠花园项目消防验收的过程中许诺以低价购房的方式,给予其好处。   受贿5万元获刑一年十个月   虽然低价购房未被一审法院认定存在受贿。但是,余×然被侦查机关带走调查后主动供述另一单受贿事实。一审法院予以了认定。2013年期间,余×然关照深圳市永利实业发展有限公司承接的东海国际中心二期b区公寓工程项目,使该项目顺利通过验收,收受该公司副总经理兼项目经理马锡军给予的5万元。   一审法院认为,余×然被检方掌握的是低价购房线索,但并未认定,因而余×然主动供述受贿5万元事宜应属自首。法院依据的是最高检《关于办理职务犯罪案件认定自首、立功等量刑情节若干问题的意见》第一条规定。自首即可以从轻处理。余×然一审被判处有期徒刑一年十个月,判刑之日为2015年12月23日,两天后余×然刑满释放。   法院释疑   低价买房为何不予认定受贿?   低价买房为何不予认定受贿?此案庭审中,余×然翻供,否认曾接受请托获得低价购房的许诺。一审法院指出,本案在侦查阶段未提取证人朱洪升的证言,朱洪升的证言是在庭审期间补充,而朱洪升事后称作出证言时全程处于迷迷糊糊的发病状态。而一审法院通知其出庭作证其亦没有正当理由而予以拒绝,法院未予采信朱洪升的证言。   对于郑稳棠的证言,法院指其部分证言与余×然的供述存在矛盾,且无其他证据相互印证,不予采信。关键性证人———地产公司总经理陈京下落不明,没有作出证言。综上所述,不能认定田厦公司在余×然对田厦翡翠明珠花园项目消防验收过程中许诺以低价购房方式给予好处。   另一关键性问题在于,余×然是否以明显低于市场价格购买涉案的房屋。一审法院认定,根据最高法、最高检《关于办理受贿刑事案件适用法律若干问题的意见》的规定,以开发商事先设定的不针对特定人的最低优惠价格购买房屋的,不属于受贿。   也就是说,倘若除了余×然,其他人也享受这一优惠,不该认定余×然是受贿。虽然田厦公司出具销售表显示,余×然购房的同月,销售的其他六套房产享受优惠均在9折及以上,但该公司此后有关回函及合同显示,两个月后的2011年12月,该楼盘销售的两套房产,一套位于12楼一套位于26楼,两套房均为158平方米,价格一个仅为297万元,另一个只有238万元,显然他们享受的折扣更低。   他们为何能以更低折扣购房?侦查机关并未予以调查。法院据此认定,没有证据显示这两人享受的折扣仅仅是针对他们两人的优惠。对比之下,余×然所享受的优惠更不应该被认为仅仅是针对他个人的优惠了。此外,法院还认定,现有证据显示,该楼盘系村集体土地旧改房,余×然购买的是村民回迁安置完成之后的剩余房源,楼层低,未公开对外发售。而且,购房时距开盘已近一年,房地产市场宏观调控,以及被告人一次性付款购买房屋等均直接影响到他的购房优惠。综合来看,法院认为没有证据能证实,开发商设定的最低优惠标准到底是多少,因而不能认定余×然是以明显低于市场价格购房。 责任编辑:于越杨 SN185相关的主题文章:
